Welcome to OtherHalf. These Terms of Service ("Terms") govern your use of the OtherHalf mobile application (the "App") operated by OtherHalf ("we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.
Section 01Eligibility
- You must be at least 18 years old to create an account and use the App.
- By using the App, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
- You may only maintain one account. Duplicate accounts may be terminated.
Section 02Your Account
- Registration: You must provide accurate and complete information when creating your account. You are responsible for maintaining the accuracy of your profile information.
- Security: You are responsible for safeguarding your account credentials. You agree to notify us immediately of any unauthorized use of your account.
- Account Actions: We reserve the right to suspend or terminate your account if you violate these Terms, engage in harmful behavior, or if we determine such action is necessary to protect other users or the integrity of the App.
Section 03User Conduct
You agree to use the App in a manner consistent with its purpose as a dating and social connection platform. You agree NOT to:
- Misrepresent your identity, including using false information, someone else's photos, or impersonating another person.
- Harass, abuse, threaten, stalk, or intimidate other users.
- Send spam, solicitations, or commercial messages to other users.
- Post or share content that is illegal, harmful, threatening, abusive, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable.
- Use the App for any illegal purpose or in violation of any applicable laws.
- Engage in, facilitate, or promote human trafficking or sexual exploitation of any kind — including commercial sexual services, escort services, or the solicitation or recruitment of any person for them — or aid, abet, or encourage abuse of any person.
- Attempt to gain unauthorized access to other users' accounts, our servers, or any systems connected to the App.
- Use automated systems (bots, scrapers, crawlers) to access or interact with the App.
- Exploit or manipulate the matching algorithm, compatibility system, or any App feature for purposes other than genuine personal connection.
- Share another user's private information (messages, photos, contact details, or profile content) outside the App without their explicit consent. The one exception is the App's own share feature, which lets you share a limited, anonymised card of a profile you were shown (see the Privacy Policy, "Sharing a profile card"): that card never includes the person's photo, full name, or location, and you may not add them yourself.
We reserve the right to investigate and take appropriate action against anyone who violates these Terms, including removing content, suspending accounts, and reporting to law enforcement. Our Acceptable Use Policy forms part of these Terms and describes these prohibitions, our zero-tolerance categories, and how they are enforced in more detail.
Section 04Content You Create
- Your Content: You retain ownership of the content you create and share on the App (photos, bio text, messages, custom tags). By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App for the purpose of providing the service.
- Content Standards: You are solely responsible for the content you post. Content must comply with the User Conduct rules above and must not infringe on any third party's intellectual property rights.
- Content Removal: We may remove any content that violates these Terms or that we deem inappropriate, at our sole discretion, without notice.
Section 05Matching and Compatibility
- No Guarantees: The compatibility scores, personality assessments, and match suggestions provided by the App are for informational and entertainment purposes. We do not guarantee the accuracy of compatibility scores, the quality of matches, or any specific outcome from using the App.
- Assessment Data: Your personality assessment responses are used to calculate trait scores and compatibility with other users. These scores are approximations and improve in confidence as you answer more questions.
- Algorithm: Our matching algorithm considers your personality traits, preferences, location, and other factors. The algorithm is proprietary and may be adjusted at any time.
Section 06Purchases and Payments
- Payment Processing: Purchases are processed through the Apple App Store or Google Play Store. All payments are subject to the respective store's terms and conditions.
- No Refunds: All purchases are final and non-refundable, except as required by applicable law or the policies of Apple or Google. If you believe a purchase was made in error, contact the respective app store.
- Virtual Items: Purchased items (cosmetics, effects, themes, feature unlocks) are digital items with no real-world value. They are licensed to you, not sold, and may not be transferred, traded, or exchanged.
- Promotional Credits: Credits added to your account balance through the referral program or other promotions have no cash value, cannot be transferred, exchanged, or redeemed for money, and are not refundable. They can be spent only inside the App on eligible items. We may void credits obtained through fraud or abuse of the referral program, and unused credits are forfeited when your account is deleted or the program ends.
- Price Changes: We reserve the right to change prices at any time. Price changes will not affect previously completed purchases.
Section 07Privacy and Data Processing
Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data. The Privacy Policy is incorporated into these Terms by reference.
Consent to Biometric Data Processing
By creating an account and using the App, you acknowledge that OtherHalf processes biometric data (specifically, mathematical face descriptors derived from your verification selfie, liveness pose snapshots, and your profile photos) for the limited purpose of photo verification, as described in our Privacy Policy. You will be asked to provide separate, affirmative consent through an in-app screen before this processing begins.
You may withdraw your consent at any time by contacting us at support@otherhalf.love or by deleting your account; withdrawing consent will disable the photo-verification feature on your account.
Section 08Safety and Reporting
- Your Safety: While we implement safety features (blocking, reporting, content filtering), we cannot guarantee your safety when interacting with other users. Exercise caution and good judgment when communicating with matches.
- Meeting in Person: If you choose to meet someone you connected with through the App, do so in a public place and inform someone you trust of your plans. We are not responsible for the conduct of any user, whether online or offline.
- Reporting: If you encounter inappropriate behavior, content, or feel unsafe, please use the in-app reporting feature or contact us at support@otherhalf.love. We take all reports seriously and investigate promptly.
Section 09Intellectual Property
- Our Property: The App, including its design, features, algorithms, compatibility system, Energy Prism visualization, brand elements, and underlying technology, is owned by OtherHalf and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App.
- Trademarks: "OtherHalf," the OtherHalf logo, "Energy Prism," and related marks are trademarks of OtherHalf. You may not use these marks without our prior written permission.
- Feedback: If you provide us with feedback or suggestions, you grant us the right to use that feedback without any obligation to you.
Section 10Disclaimers
- AS-IS Basis: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- No Warranty on Matches: We do not warrant that you will find a match, that compatibility scores are accurate, or that the App will meet your expectations.
- Service Availability: We do not guarantee uninterrupted or error-free operation of the App. We may modify, suspend, or discontinue any part of the App at any time.
Section 11Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OTHERHALF SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
Section 12Indemnification
You agree to indemnify and hold harmless OtherHalf, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of another person.
Section 13Dispute Resolution
- Informal Resolution: Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@otherhalf.love. We will attempt to resolve the dispute within 30 days.
- Governing Law: These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
- Jurisdiction: Any disputes not resolved informally shall be brought in the courts located in Florida, USA.
Section 14Termination
- By You: You may delete your account at any time through the App settings. Account deletion will be completed typically within hours, and in all cases within 30 days.
- By Us: We may suspend or terminate your account at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if we deem such action necessary to protect other users or the App.
- Effect of Termination: Upon termination, your right to use the App ceases. Provisions that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution) will continue in effect.
Section 15Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you should stop using the App and delete your account.
Section 16General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and OtherHalf regarding your use of the App.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
- Assignment: You may not assign your rights under these Terms. We may assign our rights without restriction.
